These Terms of Service ("Terms") govern your use of the Gondena™ platform, website, and related services ("Services") operated by Gokhan Goymen, doing business as Gondena ("Gondena," "we," "us"). By creating an account, applying as a Pro, or using the Services in any way, you agree to these Terms. If you don't agree, don't use the Services.
Gondena is a marketplace. We connect customers ("Customers") who need services for their home or business with independent service professionals ("Pros"). We do not perform services ourselves. Pros are independent contractors, not employees, agents, or partners of Gondena.
You must be at least 18 years old to use the Services. By using Gondena, you represent that you meet this requirement and that all information you provide is accurate.
You're responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access.
If you apply or operate as a Pro, you represent and warrant that:

Pros are subject to a background check during the application process. By applying, you authorize Gondena to obtain a consumer report about you, which may include criminal history, public records, identity verification, and license verification. The check is performed manually using public records sources and consumer-reporting services. Approval is not guaranteed and depends on the results of this review and our overall judgment.
If we deny your application based in whole or in part on information from a consumer report, we'll notify you and provide the rights afforded under applicable law, including the Fair Credit Reporting Act ("FCRA") where applicable.
Gondena is a scheduling and matchmaking platform — not a payment processor. All payment for services rendered happens directly between Customer and Pro, off the Gondena platform. Gondena is not responsible for collecting, holding, refunding, or disputing any payments between Customer and Pro.
Gondena is never a party to the payment between a Customer and a Pro, never holds or transfers that money, and will never ask you for your card number, bank account details, or a password. Any message that appears to come from Gondena asking for those things is not from Gondena.
You must not send card numbers, bank account or routing numbers, or passwords through Gondena messaging. Messages containing what appears to be a payment card number are refused automatically and are not delivered. A Pro's profile shows only which methods that Pro accepts (for example cash, card, Zelle, Venmo, Cash App or check); Gondena does not store, display or pass on any account name, handle or number belonging to a Pro or a Customer.
Payment methods such as Zelle, Venmo and Cash App may offer little or no protection for purchases and payments made with them are often irreversible. You choose how you pay and you do so at your own risk. Gondena does not endorse, recommend or guarantee any payment method.
A one-time $29.99 registration fee is charged when you submit your Pro application. This registration fee is refundable only if you withdraw your application before your background check begins; once the check is initiated, it is nonrefundable. If approved, you then receive a 90-day free trial, after which a subscription fee of $19.99 USD per month for each crew applies. All fees shown are exclusive of sales tax; any applicable sales tax is added to the amount you are charged.
A “crew” means one team that can perform one job at a time. You tell us how many crews you operate when you apply, and you may change that number at any time in your account settings. Your monthly fee is $19.99 multiplied by the number of crews you have set — for example, a Pro operating three crews pays $59.97 per month. Changing your crew count changes your fee from that point forward, and the amount is adjusted proportionally for the remainder of the current billing period. Your crew count also determines how many bookings you can accept in the same time slot.
The fee is billed monthly until you cancel. You may cancel at any time, and your subscription will remain active through the end of your current billing period.
Subscription fees do not entitle you to any minimum number of leads, jobs, or revenue. Subscription fees are non-refundable except where required by law.
Customers may submit reviews of Pros after services are completed. Reviews must reflect honest experience and may not contain defamatory, harassing, or fraudulent content.
Gondena uses a three-strike auto-suspension policy: if a Pro receives three (3) verified one-star reviews within any rolling 90-day period, that Pro will be automatically suspended pending review. Suspended Pros may appeal in writing.
Pros indemnify Gondena. You agree to indemnify, defend, and hold harmless Gondena and its founder, agents, and contractors from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or relating to: (a) your services performed for Customers; (b) your breach of these Terms; (c) your violation of any law or third-party right; (d) any false statement or misrepresentation in your application; or (e) any property damage, bodily injury, or other harm caused by you.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. GONDENA DOES NOT WARRANT THE QUALITY, SAFETY, LEGALITY, OR ACCURACY OF ANY PRO'S SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GONDENA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. GONDENA'S TOTAL LIABILITY TO ANY USER WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID GONDENA IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE OR (B) ONE HUNDRED U.S. DOLLARS ($100).
You may stop using the Services at any time. We may suspend or terminate any account at our discretion, including for: violations of these Terms, fraud, harassment, false information in applications, or three-strike auto-suspension as described above.
We may update these Terms from time to time. Material changes will be communicated via email and posted on this page with a new effective date. Continued use of the Services after changes constitutes acceptance.
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to personal jurisdiction there.
These Terms are written and published in English. English is the controlling language. If we provide a translation of these Terms into any other language, it is offered only as a convenience, and the English version governs and prevails in the event of any difference, conflict, or dispute over meaning.
